Terms of Service
These terms cover decoratorsunited.com, our quotes and orders for custom patch hats, our contract hat sewing for decorators, and the Decorators United hat mockup generator.
01Agreement
These Terms of Service (“Terms”) are an agreement between you and Decorators United (“we”, “us”), based in Spokane, Washington. By using our website, requesting a quote, placing an order, sending us goods to sew, or using the mockup generator, you agree to these Terms and to our Privacy Policy. If you act for a business, you agree on its behalf and confirm you can do so.
02Our services
- Custom patch hats. We source blank headwear, produce or source your patches, and sew them on. Minimum order is 24 units unless your quote says otherwise.
- Contract hat sewing. We sew patches and labels onto headwear you supply, for screen printers, embroiderers and other decorators, and can blind-ship under your name.
- Mockup generator. An online tool for placing artwork on images of blank hats, exporting mockups and sending a design to us for a quote.
We may change, pause or discontinue any part of the website or generator at any time.
03Quotes, proofs & orders
- A quote request is not an order. Prices come only in a written quote from us and are valid for the period stated in it.
- An order is confirmed when you accept the quote, approve the proof, and pay any required deposit. Production starts after proof approval. Changes after approval may change price and timing.
- Proofs and mockups are visual guides. Colors, sizes, placement and texture of finished products can vary with materials, blank stock and production. Please check spelling, colors and placement on every proof: you are responsible for what you approve.
- Blank availability is set by our suppliers. If a style or color becomes unavailable, we will offer the closest substitute for your approval before using it.
- Balances are due as stated on your quote or invoice, and orders ship once paid unless we have agreed other terms in writing. Prices exclude taxes and shipping unless stated.
04Contract sewing & supplied goods
- Ship goods to us with a packing list and your order reference. We count items on arrival and report any shortage or damage before production.
- We handle supplied goods with reasonable care. Sewing involves needles and heat on finished goods, so occasional spoilage can happen. We will tell you about any item damaged in our care. Unless agreed in writing, our responsibility for a damaged supplied item is limited to replacing it with a comparable blank or crediting its documented cost, and we recommend sending a few extra pieces on larger runs.
- Blind shipping: when you ask, we ship under your name with no Decorators United branding, and we do not contact your customers. We keep your customer and order details confidential.
- Goods left with us more than 60 days after we tell you an order is ready, or after a cancelled order, may be returned to you at your cost.
05Shipping & delivery
Turnaround times are estimates that start after proof approval and receipt of all materials and payments due. We ship from Spokane, WA, nationwide, and local pickup may be available. Risk of loss passes to you when the order is handed to the carrier or picked up. Carrier delays are outside our control.
06Defects & returns
Custom and decorated products can’t be returned or exchanged. If something arrives with a production defect or doesn’t match your approved proof, email us photos within 7 days of delivery and keep the items. We will repair, remake or credit the affected items, at our option. Variation within normal production tolerance, and errors in a proof you approved, are not defects.
07Your artwork
You keep ownership of the logos, images and text you send us or upload (“Your Content”). You let us use Your Content only as needed to quote, proof, produce and ship your order, run the generator, and comply with law. We will not use Your Content to promote our business without your permission.
Each time you send or upload artwork, you confirm that:
- you own it or have permission from the owner to use it for mockups and to reproduce it on products;
- it does not infringe anyone’s trademark, copyright, trade dress, publicity or other rights, and is not unlawful; and
- you will show proof of your rights if we ask. We may pause or refuse an order until you do.
08Prohibited uses
You must not use our services to:
- produce or mock up products using other people’s trademarks, team or league marks, characters or artwork without permission, including counterfeits and “inspired by” knock-offs;
- create hateful, harassing, obscene or otherwise unlawful material, or anything that exploits minors;
- present a mockup as an official product of a brand;
- copy, scrape or resell the website or generator, its hat images or rendering, or get around its watermarks, plans or licence checks; or
- disrupt, overload or probe our systems, or upload malware.
The generator may screen text and file names for well-known brand names. Screening is a safety net, not a legal review, and never confirms you have the right to use something. We may refuse or cancel any order, and remove content, that we believe creates legal risk.
09Mockup generator & plans
- Free plan. Free exports carry a Decorators United watermark or pattern, and you can save a limited number of designs.
- Paid plans. When paid plans are offered, they are billed in advance, monthly or yearly, through our payment provider and renew automatically until you cancel. You can cancel any time; access continues to the end of the paid period. Except where the law requires otherwise, payments are non-refundable. We will give at least 30 days’ notice of price changes, which apply from your next renewal.
- Licences and seats. A licence key or account is for the number of seats you bought. Don’t share or resell it. We may deactivate keys that are shared, or tied to a refunded or charged-back payment.
- Your exports. You may use mockups and documents you create for your own and your clients’ business, subject to these Terms and the rights in your artwork.
10Infringement reports
If you believe something made or shown through our services infringes your rights, email michael@decoratorsunited.com with: your contact details; the work or mark involved; where it appears or the order involved; a statement that you believe in good faith the use is not authorised; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorised to act for the owner; and your signature. We act on valid notices and may remove material, cancel orders and end service for repeat infringers.
11Our content & third-party marks
The website, the generator (its software, hat images and rendering), our text and our branding belong to Decorators United or our licensors. Some photos on our website are licensed stock photography used for illustration. Brand names and logos visible in those photos belong to their owners and do not mean those companies endorse or work with us.
12Disclaimers
Except as stated in these Terms or in a written quote, our website, generator and services are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Mockups are approximations, and we do not warrant that brand screening will catch all protected material.
13Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim is limited to the amount you paid us for the order or service the claim relates to, or US$100 if you paid nothing.
Some places don’t allow these limits; there, they apply only as far as the law permits.
14Indemnification
You will defend and indemnify Decorators United, its owners, employees and contractors against claims, losses and costs (including reasonable attorneys’ fees) arising from Your Content, products made from it at your request, or your breach of these Terms, including any claim that Your Content infringes someone’s rights.
15Governing law
These Terms are governed by the laws of the State of Washington, USA. Disputes will be heard only in the state or federal courts in Spokane County, Washington, and you consent to their jurisdiction. Either side may use small-claims court where eligible. Claims must be brought individually, not as part of a class action.
16General
We may update these Terms by posting a new version here with a new effective date. Changes apply to orders and use after that date. Your quote, approved proof and invoice control if they conflict with these Terms. If any part of these Terms can’t be enforced, the rest still applies. You may not transfer these Terms without our consent.
